4. Terms & Conditions (User Agreement)

Company Background

Ananta Business Services is engaged in software development and business solutions for over 10 years, including CRM, ERP, and customized applications.

Nature of Service

• Gaty.in provides a Software-as-a-Service (SaaS) platform.
• Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied.

User Acceptance

By accessing or using the platform, the user agrees:

• To be bound by these Terms.
• To use the service at their sole risk.
• Not to misuse, reverse engineer, attempt unauthorized access to, or interfere with the platform or its infrastructure.

Limitation of Liability

To the maximum extent permitted under applicable Indian law, the Company shall not be liable for any:

• Direct, indirect, incidental, special, punitive, or consequential damages;
• Loss of profits, revenue, goodwill, or business opportunities;
• Data loss, data corruption, or system failure;
• Cyber incidents, hacking, or unauthorized access;
• Errors, interruptions, delays, or service downtime.

Indemnity Clause

The user agrees to indemnify and hold harmless Ananta Business Services, its owners, directors, employees, and partners from and against any:

• Claims;
• Liabilities;
• Losses;
• Damages or legal expenses;

arising out of or in connection with misuse of the platform, violation of these Terms, or breach of any applicable law.

Payment Terms

All payments made for services are:

• Final;
• Legally binding;
• Non-refundable.

No claims, disputes, chargebacks, or refund requests shall be entertained, as further detailed in the Cancellation, Return & Refund Policy.

Intellectual Property

All software, design, content, branding, and technology used in or made available through Gaty.in are and shall remain the exclusive property of Ananta Business Services.

• Unauthorized copying, distribution, resale, sublicensing, or modification is strictly prohibited.
• Users receive only a limited, non-exclusive, non-transferable right to use the platform in accordance with these Terms.

Suspension & Termination

The Company reserves the right, at its sole discretion, to:

• Suspend, restrict, or terminate user access to the platform without prior notice; and/or
• Take appropriate action in case of suspected misuse, fraud, security risk, or legal violations.

Force Majeure

The Company shall not be liable for any failure to perform its obligations, or for any delay, arising out of events beyond its reasonable control, including but not limited to:

• Natural disasters, acts of God, or pandemics;
• Cyber attacks or large-scale security incidents;
• Government restrictions, regulatory changes, or legal orders;
• Technical failures, infrastructure outages, or third-party service disruptions.

Governing Law & Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of India.
• Civil courts located in Delhi shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

Modification of Terms

The Company reserves the right to modify, amend, or update these Terms at any time, without prior individual notice.

Continued access or use of the platform after such changes shall constitute the user’s deemed acceptance of the updated Terms.
